Ramon Horst Media is a sole proprietorship of Ramon Dominique Horst, registered with the Netherlands Chamber of Commerce under number 90340620.
3.1 These Terms of Service apply to all offers, quotes and Agreements between Ramon Horst Media and Customer.
3.2 By accepting the offer through the Stripe Checkout session, Customer expressly accepts these Terms of Service.
3.3 By ticking the confirmation checkbox during the order, Customer declares to be acting as or on behalf of a business, and not as a consumer. This declaration is part of the Agreement.
3.4 Any general terms and conditions of the Customer are expressly rejected.
4.1 The Agreement is formed at the moment Customer places an order through Stripe Checkout and the order is successfully processed.
4.2 Ramon Horst Media subsequently sends a confirmation by email.
5.1 GEO Quickscan ($99 USD excl. VAT): a one-off concise audit of the GEO readiness of a website specified by Customer. Delivery within 2 to 3 Business days after order, in the form of a markdown and PDF report by email.
5.2 GEO Audit Pro ($295 USD excl. VAT): a comprehensive audit of the GEO readiness of a website specified by Customer, including citation tests across five AI engines, GSC analysis, competitor benchmark and prioritised action list. Delivery within one working week after order, in the form of a markdown and PDF report by email.
5.3 Citation Monitor ($19 USD per month excl. VAT): an ongoing service that monitors the GEO readiness of a website specified by Customer on a monthly basis and reports changes. Dashboard access is granted immediately after order.
5.4 Delivery times are indicative. Exceeding them does not entitle Customer to terminate the Agreement or claim damages.
6.1 Prices listed on the website are exclusive of VAT.
6.2 Standard 21% Dutch VAT applies. If Customer holds a valid EU VAT number and provides it during checkout, the VAT is reverse-charged.
6.3 VAT calculation is automatically handled by Stripe Tax.
6.4 Ramon Horst Media reserves the right to adjust prices. Changes do not apply to orders already placed.
7.1 Payment is made in advance through Stripe Checkout. Accepted payment methods include iDEAL and card payment.
7.2 Recurring subscriptions (Citation Monitor) are automatically charged monthly via Stripe.
7.3 In the event of late payment of a recurring instalment, access to the service is suspended until payment is received.
8.1 One-off reports are sent by email to the address provided by Customer within the timeframe specified in article 5.
8.2 Citation Monitor access is granted immediately after successful payment via a dashboard.
8.3 Delivery times are indicative and not strict deadlines. Exceeding them does not entitle Customer to terminate or claim damages.
9.1 Ramon Horst Media is liable solely for direct damage resulting from an attributable failure in performing the Agreement.
9.2 Liability is in all cases limited to the amount paid by Customer for the Service in question.
9.3 Liability for indirect damage, consequential damage, lost revenue or lost profit is excluded.
9.4 Any claim for damages lapses one year after the date on which the damage arose, unless filed in writing within that period.
9.5 The limitation of liability does not apply in cases of intent or wilful recklessness.
10.1 All intellectual property rights to reports, methodology and software supplied by Ramon Horst Media remain with Ramon Horst Media.
10.2 Customer obtains a non-exclusive right to use the report internally within their own organisation.
10.3 Resale, republication or disclosure of the report to third parties without prior written consent is not permitted.
11.1 Both parties undertake to keep confidential any information received from the other party in the context of the Agreement.
11.2 If Customer grants Ramon Horst Media access to Google Search Console or comparable systems, this access is used solely for the performance of the Agreement and revoked or destroyed after delivery.
12.1 Citation Monitor subscriptions can be cancelled monthly through the Stripe Customer Portal.
12.2 Cancellation takes effect at the end of the current billing period. No refund is given for remaining days.
12.3 Dashboard access ends at the end of the billing period.
13.1 Neither party is bound to perform obligations under the Agreement to the extent prevented by force majeure.
13.2 Force majeure includes, among others: outages in networks or payment services, the failure of suppliers of Ramon Horst Media (including Stripe and Hetzner), incapacity for work and government measures.
14.1 Ramon Horst Media reserves the right to amend these Terms of Service.
14.2 Changes affecting recurring subscriptions are communicated to Customer by email at least 30 days before they take effect. Customer has the right to cancel the subscription before the change takes effect.
14.3 For one-off products, the terms in force at the time of order apply.
15.1 The Agreement and these Terms of Service are governed exclusively by Dutch law.
15.2 Disputes arising out of or in connection with the Agreement shall be submitted to the competent court of the District Court of Northern Netherlands, location Assen.
16.1 If any provision of these Terms of Service is found to be void or voidable, the remaining provisions shall remain in full force.
